Terms of Service
These Terms of Service ("Terms") govern your use of the Food Journal mobile application and related services (the "Service"), operated by Kin-Lung Wong ("Food Journal," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms and our Privacy Policy.
1. Eligibility and availability
You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. The Service is offered only to users located in the United States. You may not use the Service if doing so would violate applicable law.
2. Your account
Certain features require an account. You agree to provide accurate information, keep your sign-in credentials secure, and promptly update information that changes. You are responsible for activity under your account and must notify us if you suspect unauthorized access.
3. What the Service provides
Food Journal helps you log meals, organize nutrition information, view trends, and obtain automated nutrition estimates. Estimates may be generated from text, speech transcripts, or photos using artificial intelligence and information from third-party sources.
4. Acceptable use
You agree not to:
- use the Service unlawfully or infringe another person's rights;
- upload malicious code or content you do not have the right to use;
- attempt to gain unauthorized access to the Service or another user's account or data;
- interfere with, overload, scrape, reverse engineer, or circumvent security or usage limits of the Service, except where the law does not permit that restriction;
- use automated outputs to make high-impact decisions about another person; or
- misrepresent automated estimates as professional medical advice.
5. Your content
You retain ownership of meal entries, photos, notes, edits, and other content you submit ("User Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, and process User Content only as needed to provide, secure, maintain, and improve the Service and comply with law. You represent that you have the rights needed to submit your User Content. We do not use your private meal photos in advertising without your separate permission.
6. Subscriptions, billing, and trials
Food Journal may offer a Pro plan for approximately US$10 per month or US$80 per year and a Bring Your Own Key ("BYO") plan for approximately US$5 per month or US$40 per year. The exact price, billing period, taxes, currency, features, and any introductory offer are shown before purchase and control if they differ from this summary.
- Subscriptions are processed by Apple through the App Store or Google through Google Play, not directly by us.
- Subscriptions renew automatically unless canceled at least as required by the applicable store before the end of the current billing period.
- You can manage or cancel a subscription through your Apple or Google account settings. Deleting the app or your Food Journal account does not automatically cancel a store subscription.
- Food Journal may offer a one-time, 7-day app-managed Pro trial without requiring a payment method. This trial is not a store subscription, ends automatically, and will not charge you. To continue paid access after it ends, you must explicitly choose and confirm a paid plan.
- Refunds and billing disputes are handled under the applicable store's rules, subject to rights you may have under law.
We may change plan features or prices prospectively. The applicable store will provide any notice or consent required for subscription price changes.
7. Third-party services
The Service relies on third parties for authentication, hosting, artificial intelligence, search, speech recognition, subscriptions, and payments. Their separate terms and privacy policies may apply. Apple and Google are not responsible for support or maintenance of the Service except as their rules require.
8. Food Journal intellectual property
Except for User Content and third-party materials, the Service—including its software, design, branding, and documentation—is owned by Kin-Lung Wong or licensed to us and protected by intellectual-property laws. These Terms give you a personal, limited, revocable, non-transferable, non-exclusive right to use the Service for its intended purpose.
9. Suspension and termination
You may stop using the Service at any time. To request account and data deletion, email developer@valentinowong.com. We may limit, suspend, or terminate access when reasonably necessary to protect the Service or users, comply with law, address nonpayment, or respond to a material breach of these Terms. Sections that by their nature should survive termination will survive.
10. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. We do not warrant the accuracy of nutrition data, AI output, third-party information, or speech transcription. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, Kin-Lung Wong and Food Journal will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Service. Our total liability for all claims relating to the Service will not exceed the greater of US$100 or the amount you paid for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.
12. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Kin-Lung Wong and Food Journal from claims, losses, liabilities, and reasonable costs arising from your User Content, unlawful misuse of the Service, or material violation of these Terms or another person's rights.
13. Disputes, arbitration, and governing law
Please contact us first at developer@valentinowong.com so we can try to resolve a dispute informally. Except for claims eligible for small-claims court or requests for injunctive relief concerning intellectual-property or unauthorized-access matters, disputes arising from these Terms or the Service will be resolved by individual, binding arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. Arbitration may be conducted remotely unless the parties agree otherwise.
You and Food Journal waive the right to a jury trial and to participate in a class, collective, consolidated, or representative action to the fullest extent permitted by law. These Terms are governed by the laws of the State of New York and applicable federal law, without regard to conflict-of-law principles. If arbitration is found not to apply, exclusive venue will be in the state or federal courts located in New York, subject to applicable consumer-law rights.
14. Changes to the Service or Terms
We may update the Service and these Terms. If a change materially affects your rights, we will provide notice through the Service, by email, or by another reasonable method before it takes effect when required. The updated Terms will show a new effective date. Continued use after the effective date means you accept the updated Terms.
15. General terms
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If a provision is unenforceable, it will be modified to the minimum extent necessary and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, sale, or transfer of the Service. We are not liable for delays caused by events outside our reasonable control.
